My upstairs is always hot no matter what I set the thermostat to.

In a Murphy two-story that is almost always an air distribution problem rather than a refrigerant one. The usual culprits are undersized or badly placed return air, leaky attic duct losing cooled air before it reaches the second floor, and a system that was never zoned for a house this tall. Adding refrigerant to a system that is not low is not a fix. We can measure the static pressure and airflow and tell you which of those it is.

How worried should I be about a water heater in the attic?

Worried enough to check the pan and its drain line this week. The tank will eventually fail — every tank does — and whether that is an inconvenience or a ceiling replacement depends entirely on whether the pan drains somewhere useful. It is a five-minute check and we are happy to do it as part of any visit.
